By accessing and using the website the User acknowledges and accepts without reserve the present Terms and Conditions as they appear in their latest online version.
Description of services
VCS provides via its website information pertaining to holidays at its Villages Clubs, as well as to the location of these Villages, with a view to help Users prepare their stay.
Therefore, website Users have access to information classified by theme, allowing them to learn about the Villages Clubs as well as practical information to help them prepare their holidays.
Users may also use the website to request a telephone appointment with a customer service agent to ask questions or to book a holiday.
The Terms of Holiday Reservation soon to be available online are covered by the General Terms of Sale.
Access to the website is open to anyone wishing to learn about Villages Clubs du Soleil offers.
Access to the website is made regularly and continuously available except in the case of force majeure or other events beyond the control of VCS, and is subject to potential breakdown or maintenance work which may become necessary to ensure the smooth running of the website.
Moreover, due to the very nature of the Internet, VCS cannot guarantee a 24hr/7day/week service of its website.
3.1 VCS will do its best to provide Users with the most reliable and high-quality content possible.
However, VCS cannot guarantee the accuracy or comprehensive nature of information appearing on its website.
Therefore, VCS cannot be liable to users or any third parties for damages caused directly or indirectly from information sourced via the website, and more generally, while consulting and using the website.
3.2 VCS rates and offers are provided via the website in Euros and include taxes, but do not include registration fees, insurance, occupancy taxes, lessons and training sessions.
They apply to all customers located in mainland France, in the DOM-TOM, and to those living in a country of the European Union.
For Customers located outside of the territory of the European Union, the total cost of the holiday will be invoiced including all taxes.
VCS reserves the right to modify prices at all times, but holidays will be invoiced on the basis of the rate applicable at the time of reservation, subject to availability.
3.3 VCS does not monitor any websites connected by hypertext links and declines all responsibility concerning the aforesaid sites and their content.
4.1 All data, whatever the nature of that data, namely texts, graphics, logos, icons, images, video clips, brands, software that appears on the website must be protected by copyright, brand copyright and all other rights to intellectual property, and belong by right to VCS or to a third party having granted VCS permission to use the data.
VCS, in its role as Editor of the website, grants Users the right to private, non-collective and non-comprehensive use of the aforesaid content.
Under these conditions, Users undertake not to reproduce, resume, modify, alter or copy any text, title, application, software, logo, brand, information or illustration for any reason other than strictly personal use without prior express authorisation from the Editor, and excludes any professional or mass distribution versions. Likewise, Users promise not to copy part of or the entire content to another site or a corporate intranet network.
4.2 All accessible information and content published on the website, as well as their means of consultation, will constitute the VCS Website Database.
This Database is protected by provisions of the Code of Intellectual Property relating to copyright, as well as by the provisions of the European Directive dated 11th March 1996.
Under these conditions, Users promise to limit use of information for the sole purpose of consulting the website, and to refrain from reproducing, translating, adapting, rearranging, transforming, communicating, representing and distributing information, either permanently or temporarily, by any means and in any form whatsoever of all or part of the data contained in the databases, other than in the case provided for in paragraph 4.1 of the present article.
4.3 Creation of an Internet hypertext link to the website must be the subject of prior express authorisation by VCS.
In accordance with terms of the Law n° 78-17 dated 6th January 1978 governing the use of information technology, files and personal freedom, the Website has been declared to the CNIL (Commission Nationale Informatique et Liberté).
Website Users who have provided personal data via the website have the right, in accordance with the Article 34 of the Law dated 6th January 1978, to access this personal data, as well as the right to modify and suppress information.

Personal data concerning Users collected via the use of documents and any future information shall be used exclusively by VCS with a view to provide the services offered to Users of the Website and shall not be communicated or made available to a third party
6.1 Should any of the provisions provided for in the present Terms be considered void in light of a legal or statutory clause, current or future, or by a decision of justice authorised by judgement and issued by a jurisdiction or competent organisation, the aforesaid provision of the contract shall be considered as non-written, all remaining clauses of the present General Terms of Use shall be binding between the Parties.
6.2 VCS reserves the right to modify unilaterally the terms of the present Terms.
The new clauses will govern all future relations between the parties and the new version alone shall apply between the parties.
6.3 The present General Terms of Use are governed by French law both with regards to substantive laws and adjective laws.
In the event of litigation, both parties agree to attempt to come to a mutual agreement before bringing the case before the appropriate jurisdiction.
